Baseball & the Law!

Posted by Library Blog on 10/07/2016 at 10:37 AM

As the Red Sox roll through the playoffs, please take a peek at the newest book display in the library. It is about Baseball & the Law. The books displayed are only part of the collection of resources highlighted on our website and available in our collection. The books are also featured on the library’s Pinterest page.

After perusing the library’s collection, please check out a law review article authored by RWU School of Law Dean Michael Yelnosky in which he explains why Chad Oldfather is “out in left field” for criticizing judges who use baseball metaphors in opinions. Both articles are available via HeinOnline:

  • Michael Yelnosky, If You Write It, (S)He Will Come: Judicial Opinions, Metaphors, Baseball, and "The Sex Stuff", 28 Conn. L. Rev. 815 (1996)
  • Chad M. Oldfather, The Hidden Ball: A Substantive Critique of Baseball Metaphors in Judicial Opinions, 27 Conn. L. Rev. 17 (1994)

Also take a look at this classic humorous law review student note, Aside. The Common Law Origins of the Infield Fly Rule, 123 U. Penn. L. Rev. 1474 (1975), about the relationship between baseball’s infield fly rule and the common law.

Baseball is one of the great American pastimes, with especially strong roots in New England. But do you know how being a lawyer is like being a professional baseball player? A blog post Lawyers, Baseball Players and Social Media on “Lawyernomics” compares the skill sets of both:

Lawyering Skills

  • Writing
  • Speaking
  • Listening
  • Managing client relationships
  • Knowing the law of your specialty

Ball-Playing Skills

  • Hitting
  • Throwing
  • Catching
  • Base Running
  • Knowing how to play your position
