Anatomy of a Commercial Lease will fully explain the nuances of the major components of a commercial lease. I will provide a general overview of the purpose of a formal commercial lease and the benefits and drawbacks of having such a lease from both the Landlord’s and Tenant’s prospective.
Focused discussions will capture the importance of the Tenant Name versus the Occupant Name, restrictions on use within the property, the sudden rise in importance of the Force Majeure clause, how to best draft and enforce a personal guaranty, build-out provided by the Landlord or performed by the Tenant, the difference between “renting” and “leasing”, Term limitations and early termination, hold-over clauses and more. Attendees will benefit from knowing the subtleties of phrasing, notice and more, and leave the event with a fuller general knowledge of lease drafting.
The discussion will be supported with a typical commercial lease in draft format for distribution, as well as major points and take-aways.
