Please Use AI, Responsibly

Everyone is talking about artificial intelligence (AI) these days.  And everyone includes legal educators and law librarians.  The news broke in 2023 that GPT-4 aced the bar exam, and the story dominated the news cycle for weeks.  Those of us at law schools are especially concerned with the best way to go about teaching the next generation of lawyers to use this technology.  GPT-4 is a large language model (LLM) created by OpenAI.  It—like all LLMs—is a program trained on a large amount of data to understand and generate human-like language.  Put another way, it’s a computer program designed to answer questions for or provide information to us humans.  It can also generate written products from essays and resumes to legal documents. 

The obvious question on everyone’s mind is should we use AI products and encourage students to do so? And, more importantly, can we trust them to provide us with accurate information?  The answer to the first question is relatively easy.  Yes, of course, we should learn how to appropriately use these powerful new tools.  The lawyer's work can become more efficient through AI, which is undoubtedly here to stay.  Lawyers can generate and analyze basic documents and written products using AI.  It can also be a great way to get started with a research task.  

However, AI is only as accurate as its programming and the LLM that created it, which brings us to our second question. Should we rely on it? The consensus is that AI should only be used as a tool, something used to help with tasks but not as a replacement for human judgment and expertise. AI isn’t always accurate or appropriate for every task, so please use it responsibly.

What things should you consider when using an AI tool?  Here are a few tips.

  1. Define Your Objective: Before jumping onto an AI platform, figure out what you wish to achieve or in the case of legal research, what specific legal issue or question is at play.
  2. Provide Clear and Concise Prompts: The results that you get from any AI tool will be better if you provide clear and concise instructions.  Avoid using jargon or ambiguous language.  For example, if you want an AI tool to draft a client letter, make sure that you include the specific legal question at issue, key facts, target jurisdiction, and the desired tone of the letter (if applicable).
  3. Understand Limitations: You should be aware of the specific constraints of any particular AI tool.  What can the tool do or not do?  Most importantly, understand the data pool that the tool is using to generate content.
  4. Review and Edit: Great, AI has generated an answer or written product for you!  Now you must review that product to ensure that it is accurate, relevant, and free of plagiarism.  If drafting a document, you also want to make sure that it reflects what you wish to communicate and is free of grammatical errors and logical inconsistencies.
  5. Be Aware of Ethical Implications: As law students and lawyers, it is critically important to understand when you should and when you shouldn’t use an AI tool.  Students should never use an AI tool for school work product when they have been prohibited from doing so by their professor. If you’re not sure whether AI use is permissible for school work, check with your professor or supervisor.  Likewise, practicing attorneys must ensure the privacy of their clients through the careful drafting of prompts and by understanding the privacy policies of different platforms.  Lawyers are ultimately responsible for the ethical representation of their clients and no AI tool can replace their judgment about the complex issues surrounding a client’s legal problem.

As you are no doubt aware, legal databases are rapidly incorporating AI tools into their platforms. In many cases, AI is used to provide detailed document analysis to help in the research and drafting process.  However, this spring, both Lexis+ and Westlaw Practical Law released generative AI tools, or in other words, tools that will generate written summaries or products. In both cases, the AI tools rely solely on materials available to researchers within the databases.  Westlaw’s Practical Law AI will answer legal questions for you with a prompt.  The Lexis+ AI Assistant gives users more options and will also generate document drafts and summarize cases.  Sorry 1Ls, you won’t have access to the Lexis+ AI Assistant until next year as a second year (2L).
